A sheikhul hadith says that if there is a difference of opinion among the Fuqaha, then we should refer to the Qur'aan and Hadith for the solution.

Question

A sheikhul hadith says that if there is a difference of opinion among the Fuqaha, then we should refer to the Qur'aan and Hadith for the solution. Is he right?

Answer

He is crooked. He spoke bunkum. This shaikhul hadith is in error. We have to adopt the Mufti Bihi version. We are not mujtahids, hence we may not override the Fuqaha with Qur'aanic verses and Ahaadith. They were fully aware of the Qur'aan and Ahaadith. This molvi appears to be a Salafi deviant or a liberal modernist.
