What are the requirements for a valid Khula'?
Answer
Khula' is a voluntary agreement between husband and wife in which she pays the husband a sum of money in lieu of Talaaq to release her from the Nikah. The amount should be the Mahr amount. If the husband demands a higher payment, the Khula' will be valid, but he will be sinful. The Khula' is valid even without witnesses. Nevertheless, if witnesses are available, let them too sign. When the wife hands over the money, it is best that there be witnesses present. Khula' terminates the Nikah. After Iddat, the woman will be free to marry someone else.
