Can a person say his house should be made Waqf when he dies?

Question

Can a person say his house should be made Waqf when he dies?

Answer

If Waqf of the house is at the time of one's death, then if the value of the house is not more than one third the value of one's estate, the Waqf will be valid. However, if the value of the house exceeds the third, then only so much of the house will be Waqf which does not exceed one third the value of the estate.
