Question
A woman was separated from her husband for 40 years. While he married another woman he never gave Talaaq to his first wife. If he dies before her does she have to observe Iddat?
Answer
In view of Talaaq not having been issued, her nikah is still valid regardless of the 40 year separation. If he dies, she will have to be in Iddat. She will also inherit in his estate.
