Question

A boy and a girl in an illicit relationship of more than a year, wanted to perform Nikah. The girl‟s father refuses although he was aware of the haraam relationship. They eloped and got married. An Imaam performed the Nikah. Two Aalims were witnesses. An amount for the Mahr was also agreed. Is this nikah without the father‟s consent valid? Now the parents want a proper Nikah to be performed. If the first Nikah is valid, will it be permissible to again perform Nikah in the Musjid?

Answer

The Nikah as explained by you is valid. Since the nikah has been performed, the boy and girl are husband and wife, hence they are not committing haraam. Prior to the nikah they were conducting a zina relationship. To keep the girl's parents happy, a public Nikah may be performed. It is permissible.
