Is it permissible to sell/buy a property „off plan‟ as is the practice in Dubai? It is said that this is a form of istisna, hence permissible.
Answer
Selling a ‗property' off plan is baseless and haraam. It is not permissible to sell a ghost. Something which does not exist cannot be a commodity for trade. The claim of ‗istisna' is baatil. They are simply making a mockery of the Shariah's law regarding the issue of bay-ema‟doom (sale of something which has no real existence).
