Question

A husband has issued 2 Talaaqs to his wife while intoxicated with drugs. Kindly please advise: What is the position of the nikaah currently? What should now be done according to shariah?

Answer

The two Talaaqs are valid. If the Talaaqs were stated in clear terms, that is: he said Talaaq or Divorce, then he may revoke the Talaaqs before expiry of the Iddat. If he does not revoke the Talaaqs during the duration of the Iddat, then reconciliation will be permissible only after renewing the nikaah. Even after revoking, the two Talaaqs will remain suspended for all time. Should he once more utter Talaaq, all three will become effective and the nikaah will finally and irrevocably end. The Iddat consists of three complete haidh (menses) cycles.
