Question
My husband uttered a statement today which is confusing for me. My younger son asked him as to why he was hairy on his arms. He answered, and I heard my daughter exclaimed: "Abba you need to renew your imaan". Seeing this I asked my daughter as to what her father answered. She replied that he said that he started as a monkey or ' I was first a monkey'. I told my husband that if he had lost his imaan then our nikah too is broken.. He recited his Kalima but doesn't want to acknowledge that he was wrong. He is refusing to ask for a fatwa / advice concerning this and says that it was not his intention to mean anything wrong. He claims that it was a joke. I am not educated or familiar with the rulings but am only afraid if we are going to be in sin. Please advise me. Did he loose his Imaan and is our nikah broken?

If your husband says that he said the statement as a joke, then too it is kufr. Saying: ‗I was first a monkey', in response to the question pertaining to his hairiness, means that the origin of man was the monkey as is taught by the kaafir, Darwin and as the atheist scientists believe.
A kufr statement uttered jocularly is also kufr. The nikah should be renewed. It takes only five minutes to perform a nikah. It can be performed at home without others knowing about the issue.
Your husband may write for a fatwa to other Muftis. If he receives a fatwa in conflict with our fatwa, he may act according to the other fatwa.
