A customer purchased an item, paying a deposit.

Question

A customer purchased an item, paying a deposit. Even after months, he does not come to collect the item. All attempts to locate him fail. Should Zakaat be paid on the amount he owes? May the item be sold to recoup loss?

Answer

Zakaat will be paid on the outstanding amount only after it has been paid. Since the customer has paid a deposit, the item belongs to him. If after one year he does not come forward to pay and take the item, you may sell it to recoup the outstanding amount. If the item is sold for more than the amount owing, the excess should be given as Sadqah.
