A deceased had appointed in his will two relatives to be the executors of his estate.

Question

A deceased had appointed in his will two relatives to be the executors of his estate. Is it binding on them to accept?

Answer

If the executors had not accepted the post during the lifetime of the Testator, then they are under no obligation to accept the post. Further, they may resign in this case even after they had accepted to act as executors.
