Question
When should the executors commence the process of winding up the estate?
Answer
The process of distribution should commence immediately on the day after burial of the mayyit. There should be no unnecessary delay. The usual practice of procrastinating the winding up for no valid reason is haraam. It is a major sin. After burial, the heirs are not permitted to appropriate the assets of the deceased in whatever manner they desire. Even the food in the fridge becomes haraam for the heirs without distribution. The vehicles of the deceased may not be used without finalization of the distribution. People are absolutely reckless in the commission of major sins pertaining to the assets of the deceased.
