A man says that the money he spent for the medical treatment of his wife was a debt on her. She has now died. He claims that before distribution of her estate he must be paid for the medical expenses. It is a considerable amount. It should be noted that he did not give the money as a loan to his wife. He spent on her medical treatment from time to time as was the need. Is he right?
Answer
The money he had spent was Tabarru'. It was a voluntary act of kindness and a gift for his wife. There was no loan agreement between himself and his wife. His claim is now baseless. He may not be given from her estate what he claims to be a debt owing to him.
