Question
I am the executor of a deceased‟s estate. I am unable to finalize the estate according to the Shariah because of the problems of some heirs. Some refuse to submit to the Shariah distribution. What should I do?
Answer
If the estate cannot be finalized in accordance with the Shariah due to the intransigence and evil of some of the heirs, then it is best to resign. You are presently not serving any constructive purpose, hence it is futile for you to remain as an executor. Notify the heirs that if the Shariah is not accorded priority, you will resign. Do not be a party to any haraam compromise.
