Question
Some of the heirs were given their shares from the cash in the estate of their deceased father. The balance which was more than half the value of the total cash was stolen. What should now be done regarding the shares of the other heirs?
Answer
In this case the distribution is not valid. Those who were given their „shares‟, should return the funds, and the calculation should be done afresh. The stolen amount is lost and does not form part of the estate. The estate consists of only what has been given to some heirs. This amount has to be distributed according to the law of inheritance.
