My deceased father had a five year lease with his tenant. We, the heirs, require the premises. The lease expires only after about three years.
Answer
The lease in fact terminated with the death of your father. In terms of the Shariah, a lease cannot be transferred after one‟s death. You are therefore under no obligation to abide by the lease.
