Question

2: Arafat Hatia, a Molvi made Halaalah. Can people read salaat behind him? When he is dismissed from work or he resigns, he goes to CCMA to collect money. Is this permitted?

Answer

Those who engage in the process of Halaalah have been cursed by Rasulullah (Sallallahu alayhi wasallam). Our Nabi (Sallallahu alayhi wasallam) invoked the La’nat (Curse) of Allah Ta’ala on both the one who engages in Halaalah, and the one for whom it is arranged. Both participants are Mal-oon, Fussaaq and Fujjaar of the worst order.

It is Haraam for Muslims to seek the aid of the CCMA for usurping the wealth of their former employers. An employer, according to the Shariah is entitled to dismiss his employee even without reason. The money awarded by the CCMA is haraam. It is the ingestion of the Fire of Jahannam by the usurper.

It is haraam to appoint a faasiq to lead any Salaat. It is a kabeerah sin to appoint him. If the Salaat is Taraaweeh, then it is better to perform behind a pious Imaam even if he recites from Surah Feel. It is haraam to honour the faasiq with Imaamate.
