My deceased mother had not made a wasiyyat to pay Fidyah for her missed Salaat. The heirs are happy to pay the Fidyah. Is it permissible to set aside one third of the estate for this purpose - that is before the distribution?
Answer
No, they may not take out one third before distribution of the assets. Only after each heir receives his/her share, may they contribute of their free will whatever amount they wish. Pressure may not be applied on any heir to contribute.
