A divorced woman has custody of her nabaaligh daughter. During the day she works and leaves the child in the custody of her mother (the naani). The grandmother is not a practising Muslim. She spends a lot of time watching television. She has no concern for hijaab nor is she regular with Namaaz. On the other hand, the daadi (paternal grandmother) is a pious Deeni conscious lady. Can the father remove the child from the custody of the mother?
Answer
Yes, by all means he should do so. In fact it is Waajib for him to place his daughter in the care of the daadi. The fisq and fujoor of both the mother and maternal grandmother disqualify them. Thus they lose their rights of custody.
